Olives Range Trade Promotions

KEY TERMS

Information on how to participate in this Promotion form part of these conditions. By participating, Participants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

Details

Promoter

The Promoter is: Riviana Foods Pty Ltd of Level 1, Office Tower One, 1341 Dandenong Road, Chadstone VIC 3148 (Promoter).

Eligible Participants

Participation is open to independent retail customers of Australia with a current ABN (Participant).

Promotion Description

Eligible Participant who purchase the Participating Products during the Promotional Period will receive a 10% discount off the purchase price of the Participating Products only.

How to Participate

To participate, the Eligible Participant must:

(a)   Purchase any volume of the Participating Products directly from Roza’s Gourmet during the Promotional Period (Eligible Purchase).

(b)   Participating Products are the Roza’s Gourmet Olives range of products being the following four products: Oregano & Garlic Kalamata Olives, Chilli & Garlic Kalamata Olives, Lemon & Rosemary Colossal Olives and Garlic, Chives & Dill Colossal Olives (Participating Products).

(c)    Purchases may be made:

o    Over the phone at; 1800 748 426

o    Via email at; info@rozas.com.au

o    Via contacting your local Roza’s Gourmet Sales Representative.

Eligible Participants to make an Eligible Purchase during the Promotional Period, receive a discount of 10% of the purchase price applicable to the purchase of the Participating Products only (Promotion Discount).

Limits on Entry

The Promotional Discount will only apply to the Participating Products. In the event the Participant purchases other Roza’s Gourmet products that are not Participating Products as part of the same transaction, the Promotional Discount will only apply to the Participating Products and will not apply to the other products.

Purchasers which in the reasonable opinion of the Promoter:

(a)   are not independent retail customers of Australia with a current ABN;

(b)   are received outside the Promotional Period;

(c)    are incomplete or indecipherable; or

(d)   do not otherwise comply with these terms,

will be invalid and ineligible for any Promotional Discount.

Promotional Period

The promotion commences at 12:01am AEST on Monday 25 July 2022 and closes at 11:59pm AEST on Wednesday 31 August 2022 (Promotional Period).

FURTHER DETAILS

1.     The Promotion Discount is not transferable and are not redeemable for cash. In particular, this Promotion or the Promotion Discount may not, without the prior consent of the Promoter, be used by the Participant for advertising, Promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If the Participant acts in breach of this condition, the Promoter may, at its absolute discretion, withdraw the Promotion Discount.

2.     The Promoter accepts no responsibility for late, lost or misdirected purchases or other communications. The Promoter assumes no responsibility for any failure to Purchase the Participating Products in accordance with the terms of this Promotion, or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches, theft or destruction, any cause beyond the Promoter’s control, or unauthorised access to or alteration of the Promotion. Further, the Promoter at its sole discretion may recommence this Promotion under the same conditions.

3.     If the Promotion is ended early or the Promotion Discount becomes unavailable for reasons beyond the Promoter’s control, the Promoter will not be liable for any damage or loss sustained by the Participant due to their reliance on this Promotion.

4.     If a Participant’s contact details change at any time between the date which they Purchase the Participating Products, the date they receive the Promotion Discount and the date they pay for the Participating Products, that Participant must notify the Promoter of their correct contact details immediately.

5.     The Promoter reserves the right to request verification of Business name, ABN, address or other details or information from Participants relevant to participation in this Promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, is in breach of these conditions, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this Promotion, or who has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

6.     The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of purchasing and/or using the Participating Products or in relation to the promotion generally, except for any liability which cannot be excluded by law.

Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

7.     If in the conduct of this Promotion, the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Competition and Consumer Act 2010 (Cth) or is implied by any other commonwealth, state or territory law that cannot by law be excluded, the Promoter’s liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any Promotion Discount or other benefit received by the Participant.

8.     Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in application of the Promotion Discount.

9.     Details from Eligible Purchases’, including the business information of the Participant, will be collected and used for the purposes of conducting this Promotion. By entering this Promotion Participants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the Participant. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). A copy of the Promoter’s privacy policy can be viewed on http://www.rivianafoods.com.au/privacy-policy.

Participants may access, change and/or update their business information by contacting the Promoter on 1800 748 426 during office hours or contact the Promoter in writing at info@rozas.com.au.

Participants may ‘opt out’ of further promotional or marketing communications from the Promoter by using the ‘opt out’ function on any electronic marketing materials received, or by emailing info@rozas.com.au.

10.   Any dispute relating to this Promotion must, prior to a person initiating litigation, be dealt with as follows. The affected person (“Complainant”) will notify the Promoter of the details of the dispute in writing and within 14 days of receiving this notice, the Complainant and a representative of the Promoter will meet by videoconference to attempt to resolve the dispute. If unresolved within 30 days after that meeting, the dispute will be escalated to a more senior manager not directly involved in the Promotion, who will investigate the dispute and meet by videoconference with the Complainant to further attempt to resolve the dispute. If still unresolved within a further 14 days of being escalated, then the senior manager will make a final and binding decision subject to any legal proceedings initiated by the Complainant.

11.   These conditions are governed by the laws of New South Wales.
